Status of this documentProduction-style working draft for a private pre-launch site. It is intentionally detailed, but it is not approved legal advice. Before public use, qualified counsel must verify the company particulars, Moroccan and Qatari hospitality and consumer rules, every fee, governing-law clause, operational promise and local property schedule.
01
Purpose, scope and acceptance
These General Terms and Conditions (“Terms”) govern every contract for the temporary provision of a furnished apartment, studio, room or other accommodation unit (a “Unit”), together with any related service, entered into through an Asfour direct channel. They also govern use of this website, the availability-enquiry process, digital or in-person check-in and conduct at a property.
By submitting a booking request, accepting a quotation, paying any amount, completing check-in or using a Unit, the Guest confirms that they have had an opportunity to read and accept the Terms made available before the relevant commitment. An availability enquiry alone is non-binding and does not create a reservation.
Mandatory consumer, hospitality, tourism, safety, privacy and accommodation law always prevails. Nothing in these Terms removes a right that cannot lawfully be waived. Property-specific rules, a rate plan and the written booking confirmation supplement these Terms.

Definitions and interpretation
- Accommodation Contract
- The binding contract created when Asfour or the named Accommodation Provider issues a written booking confirmation.
- Accommodation Provider
- The Asfour entity, local operating company, owner or authorised property partner identified in the booking confirmation as providing the stay.
- Booker
- The person or organisation making or paying for a booking, whether or not that person will occupy the Unit.
- Guest
- The Booker and every registered occupant, as the context requires. The lead Guest is responsible for communicating these Terms to all occupants and visitors.
- House Rules
- These Terms, property signage, safety instructions, the booking confirmation and any reasonable written rule supplied for the relevant property.
- Serious Breach
- Unlawful activity, prohibited substances, violence, deliberate damage, material deception, a major safety risk or another breach identified as serious in these Terms.
Headings are for navigation only. “Including” means “including without limitation”. A reference to writing includes email and another durable electronic message. A reference to law includes binding local rules and lawful directions of a competent authority.
Back to contents ↑03
Contracting party and order of documents
The proposed central contracting entity is Asfour Hospitality & Technology W.L.L., Level 22, Tornado Tower, West Bay, Doha, State of Qatar, CR No. 208741 (“Asfour”, “we”, “us” or “our”). The actual Accommodation Provider for a stay must be stated in the booking confirmation and may be a local operating company or authorised property partner. The confirmation must also identify the property, Unit category, dates and total price.
If documents conflict, the following order applies unless mandatory law requires otherwise: (1) individually negotiated written terms; (2) the booking confirmation and rate conditions; (3) the property-specific schedule; (4) these Terms; and (5) general website descriptions. A third-party booking platform’s terms govern the relationship with that platform, but these House Rules continue to govern conduct at the property.
A Booker’s own purchasing or general terms do not apply unless the Accommodation Provider accepts them expressly in writing.
Back to contents ↑04
Eligibility, authority and third-party bookings
The lead Guest must be at least 18 years old and legally capable of entering the Accommodation Contract. A higher age threshold may be stated for a property where lawful. Minors may occupy a Unit only with a responsible adult or under another arrangement expressly accepted in writing and permitted by law.
A person booking for another Guest confirms that they are authorised to provide the Guest’s details, accept these Terms and receive booking communications. A corporate Booker remains responsible for charges it has agreed to pay; each occupying Guest remains responsible for their own conduct.
The Booker must give accurate, complete and current information. We may require reasonable evidence of authority, identity, payment authority or the purpose of a third-party booking. Fraud, impersonation, altered documents or concealment of the true occupant or purpose may result in refusal or immediate termination.
Back to contents ↑05
Enquiries, offers and formation of a booking
Website descriptions and availability indications are invitations to enquire, not binding offers. A quotation is valid only for the period stated and remains subject to availability, identity checks, payment and any stated booking conditions.
The Accommodation Contract is formed only when the Accommodation Provider sends a written confirmation that includes a booking reference and the essential stay details. An automated acknowledgement that a message was received is not a confirmation unless it clearly says otherwise.
The Guest must review the confirmation promptly and report an error without delay. A request to change a confirmed booking is effective only after written acceptance. We may refuse a request before confirmation, subject to applicable non-discrimination and consumer law.
Back to contents ↑06
Unit category, allocation and substitutions
A booking is normally for the confirmed Unit category, not a particular apartment number, floor, view or furniture layout, unless that feature is expressly guaranteed in writing. Photographs show the general style; dimensions, finishes and individual items may reasonably vary.
For operational, maintenance, safety or accessibility reasons, we may allocate another Unit in the same category or a reasonably comparable or better category. If no reasonable alternative can be provided, the Guest may receive a refund of the affected accommodation price and any other mandatory remedy.
Requests for a cot, connecting units, a particular floor, allergy-related preparation or another preference are subject to availability until expressly confirmed. Accessibility requirements should be raised before booking so suitability can be checked honestly.
Back to contents ↑07
Prices, taxes and invoices
The binding price is the total shown in the booking confirmation, subject to manifest error and mandatory changes in tax or public levies. The confirmation must state what is included and identify any tourist tax, city tax, security deposit, optional service or other amount payable separately.
Prices may vary by date, length of stay, occupancy, cancellation flexibility and sales channel. A later reduction in nights, Units or services may change the nightly rate. Promotional or membership prices apply only if their conditions are met and may not be combined unless stated.
The Guest is responsible for exchange-rate differences, bank fees and card-provider charges not imposed by us. An invoice is issued in the contracting entity’s invoicing currency. Obvious pricing errors do not create a right to purchase at an implausible price; we will offer the corrected price or allow cancellation before performance begins.
Back to contents ↑08
Payment, authorisations, deposits and chargebacks
Payment dates, accepted methods and any security deposit are stated in the confirmation. Unless another schedule is agreed, accommodation may be required in advance. The Booker confirms that they are authorised to use the selected payment method.
Where law and the payment mandate permit, the Accommodation Provider or its disclosed payment provider may pre-authorise or charge the payment method for amounts properly due, including the confirmed price, extensions, agreed extras, documented damage, missing items, abnormal cleaning and lawful breach-related charges. A pre-authorisation is not a final charge and release timing depends on the issuing bank.
If payment is late, declined, reversed or disputed without valid grounds, we may request another method, suspend access or cancel the booking after any notice required by law. A chargeback does not extinguish a valid debt. We may recover reasonable collection costs and statutory interest where legally permitted.
Security deposits are not a limit on liability. Any deduction must be explained and supported proportionately. The remaining balance will be released or returned within the operational and banking period disclosed for the booking.
Back to contents ↑09
Cancellation, no-show, early departure and extensions
The cancellation and amendment conditions displayed for the selected rate and repeated in the confirmation control. Flexible, semi-flexible, non-refundable, group and long-stay rates may have different deadlines and charges.
A cancellation must be sent through the channel stated in the confirmation and is effective when received. After the free-cancellation deadline, the Guest must pay the contractual cancellation amount, reduced by savings or re-letting proceeds where the governing law requires. Refund timing depends on the original payment method.
A no-show occurs when the Guest has neither checked in nor contacted us by the stated cut-off. We may release the Unit for later nights and retain amounts permitted by the rate conditions and law. Early departure does not automatically create a refund. An extension is a new request, subject to availability, price and written confirmation.
For a booking made through an online travel agency or other intermediary, cancellation and refund processing must normally follow that intermediary’s channel and agreed rate conditions.
Back to contents ↑10
Changes, relocation or cancellation by us
We may make a reasonable operational change that does not materially reduce the stay. If a Unit becomes unavailable because of maintenance, safety, overbooking, government action or another operational failure, we will use reasonable efforts to offer a comparable alternative.
If the alternative is materially inferior, an appropriate price adjustment will be offered. If no reasonable alternative is available, we may cancel the affected part and refund the corresponding accommodation amount. Mandatory compensation rights remain unaffected.
We may cancel before arrival for failed payment, failed lawful identity checks, material misrepresentation, sanctions or legal restrictions, suspected fraud, an unlawful intended purpose, or another material breach. The refund position depends on the cause and mandatory law.
Back to contents ↑11
Identity, guest registration and check-in
Every occupant must be registered to the extent required for lawful operation. We may request a valid passport, national identity card, visa information, contact details and other information that the property-country law requires. Only the minimum necessary data should be collected and handled under the Privacy Policy.
Check-in may be digital, remote or in person. Access is conditional on completion of required steps, payment and acceptance of the House Rules. If identity cannot reasonably be verified because information is missing, false or manipulated, access may be delayed or refused.
Guests should not send identity documents, payment-card details or sensitive records to a general email inbox unless specifically instructed to use an approved secure channel. Check-in instructions and access credentials are confidential.
Back to contents ↑12
Arrival, departure and access credentials
Standard arrival and departure times are stated in the booking confirmation or property schedule. Early check-in and late check-out are available only when confirmed and may carry a disclosed charge.
The Unit must be fully vacated by the agreed departure time. Unauthorised overstay may be charged at a reasonable amount reflecting additional use, disrupted housekeeping, relocation or lost revenue, subject to the Guest’s right to show a lower loss where required by law.
Keys, cards, devices and codes remain property access tools and must not be copied, transferred or published. Loss or failure to return them may result in the documented cost of replacement, call-out and any security-driven lock change. Digital credentials may be deactivated at checkout or earlier following lawful termination.
Back to contents ↑13
Occupancy, visitors, children and responsibility
Only registered occupants may reside in the Unit. Maximum occupancy, fire limits and sleeping arrangements must not be exceeded. A baby or child counts where local safety or licensing rules require.
Visitors are permitted only if the property rules allow them and any required advance approval or registration is completed. The lead Guest is responsible for ensuring that occupants and invited visitors comply with these Terms, but no person is liable for another’s conduct without a lawful contractual or fault-based basis.
Children must be appropriately supervised. Balconies, kitchens, pools, stairs, windows, furniture and electrical equipment carry ordinary residential risks; the responsible adult must use reasonable care and follow safety notices.
Back to contents ↑14
Permitted use, no resale and no commercial exploitation
The Unit may be used only as temporary accommodation for the registered Guests. Subletting, resale, rebrokering, assignment, timesharing, unauthorised lodging of others and use as a registered office are prohibited without prior written consent.
Commercial filming, paid photography, product storage, sales activity, interviews, classes, medical or beauty services, catering, events and other business use require prior written approval and any necessary licence. Ordinary remote desk work by a Guest does not by itself require approval.
The address, photographs, access instructions or listing must not be published in a way that compromises security, misrepresents affiliation or invites unauthorised attendance. The Unit must not be used to receive unlawful goods or high-volume deliveries.
Back to contents ↑15
Halal, alcohol-free and family-oriented property rules
Asfour properties are intended to provide a safe, family-oriented, alcohol-free and Sharia-conscious environment. These are contractual House Rules for conduct on private property. They apply to every Guest and visitor regardless of religion, nationality or personal belief.
Strictly prohibited on the property
- bringing, storing, serving, delivering, selling or consuming alcoholic drinks or recreational intoxicants;
- gambling or wagering for money, prostitution, commercial sexual services, sexual exploitation, or producing or distributing pornographic material;
- illegal drugs, narcotics, misuse of controlled medicines, drug paraphernalia or any manufacture, sale, supply or disposal of prohibited substances;
- parties, unauthorised events, public indecency, violence, threats, harassment, exploitation, hate conduct or abuse;
- any criminal activity or conduct that violates applicable law, public order, licensing conditions, safety requirements or the rights of others.
Medicines used lawfully as directed and ordinary alcohol-based hygiene or medical products are not prohibited alcoholic drinks. Enforcement is based on observed conduct, credible evidence, property impact and lawful requirements—not assumptions about a person’s private faith.
Back to contents ↑16
Local law, relationships and required documents
Guests must comply with the laws that apply at the property, including rules on identification, immigration, accommodation registration, cohabitation, sexual conduct and public morality. Guests should obtain their own advice if uncertain about laws affecting their circumstances.
We will request proof of marriage or another relationship-status document only where a specific applicable law or competent authority lawfully requires it for that stay and the necessary privacy permissions and safeguards are in place. We do not ask Guests to declare their religion and do not create religion-based guest profiles.
We may refuse or end a stay where there are reasonable, documented grounds to conclude that the intended or actual use is unlawful. A decision will not be based solely on religion, perceived religion, nationality or another protected characteristic unless a distinction is expressly required by binding law and confirmed through local legal review.
Back to contents ↑17
Quiet hours, parties and respectful conduct
Guests must avoid noise audible outside the Unit and comply with property quiet hours, building rules and reasonable staff instructions. Unless the property schedule states stricter hours, particular care is required between 22:00 and 08:00.
Parties, gatherings beyond registered occupancy, amplified music and unauthorised events are prohibited. Guests must not obstruct corridors, entrances, lifts or neighbours, and must not contact neighbours for access or services.
Aggressive, abusive, discriminatory, sexually inappropriate, threatening or violent conduct toward staff, contractors, neighbours, authorities or other Guests is a Serious Breach. We may call security or emergency services where proportionate.
Back to contents ↑18
Smoking, fire safety, weapons and hazardous items
Smoking, vaping, shisha, heated-tobacco devices, candles, incense, charcoal, open flames and smoke-producing devices are prohibited inside Units and indoor common areas, and on balconies or terraces unless an expressly marked area allows a specific activity.
Fire alarms, smoke detectors, sprinklers, extinguishers, access controls and other safety equipment must not be covered, disabled, removed or misused. Fire doors and evacuation routes must remain clear.
Weapons, explosives, fireworks, fuel, compressed-gas canisters, highly flammable materials, hazardous chemicals and any item prohibited by law are not allowed. A lawfully carried professional item must be disclosed where the law or property security plan requires and must be stored in strict compliance with law.
Back to contents ↑19
Care of the Unit, damage, cleaning and missing items
Guests must treat the Unit, contents and common areas with reasonable care, use appliances according to instructions, ventilate appropriately and report a defect, leak, infestation, breakage or safety concern without delay. Normal wear and tear is not chargeable.
The responsible person must pay reasonable, evidenced costs caused by negligent, reckless or deliberate conduct. These may include repair, replacement, specialist cleaning, biohazard treatment, pest remediation, waste removal, security response, contractor call-out and lost revenue for the reasonable period a Unit cannot be re-let.
Extraordinary soiling includes bodily fluids, prohibited-substance residue, smoke or alcohol contamination, excessive rubbish, food or oil damage, blocked plumbing caused by misuse and conditions materially beyond ordinary residential use. Removal or theft of contents and interference with meters or technical systems are Serious Breaches.
We will provide an explanation and reasonable supporting evidence for a post-stay charge. No duplicate recovery is permitted.
Back to contents ↑20
Housekeeping, maintenance and lawful access
Housekeeping frequency and included services are stated for the rate or length of stay. Guests must permit scheduled cleaning, linen service, inspection, maintenance, pest control, safety checks and legally required access after reasonable notice.
We may enter without prior notice where reasonably necessary to respond to an emergency, prevent injury or serious damage, address an active alarm, comply with lawful authority or investigate credible evidence of a Serious Breach. Entry will be proportionate and recorded where appropriate.
Repeatedly obstructing required access may result in a reasonable call-out or disruption charge where disclosed and lawful, and may lead to termination if health, safety, legal compliance or the condition of the Unit is put at risk. Guests may not secretly monitor staff in private work areas or obstruct authorised contractors.
Back to contents ↑21
Internet, networks and digital services
Internet access is an ancillary service provided subject to technical availability, fair use, maintenance and events outside reasonable control. Speed, coverage and uninterrupted availability are not guaranteed unless expressly agreed for a business product.
Guests must not use the network to commit an offence, infringe intellectual-property or privacy rights, access or distribute unlawful content, attack systems, send spam, mine cryptocurrency at abnormal load, or share credentials with unauthorised persons. We may restrict access reasonably to protect security or comply with law.
The responsible user must reimburse losses and third-party claims caused by their unlawful network use to the extent permitted by law, including reasonable defence costs awarded or recoverable under applicable law.
Back to contents ↑22
Pets, service animals and accessibility
Pets are allowed only where the property description or written confirmation says so. Conditions may include species, number, supervision, vaccination, cleaning and a disclosed pet fee. An unauthorised animal may lead to removal and reasonable additional cleaning or damage costs.
Recognised assistance or service animals are accommodated in accordance with applicable law and are not treated as ordinary pets. Guests should contact us before arrival so a suitable and safe arrangement can be made, but no unlawful fee or documentation burden will be imposed.
We aim to describe accessibility features accurately. Because properties differ, Guests should confirm any essential step-free access, door width, lift, bathroom or sensory requirement before booking.
Back to contents ↑23
Long stays, mail and residence registration
A long stay remains temporary accommodation unless mandatory law provides otherwise. It does not create a tenancy, protected lease, domicile, permanent residence or right to remain beyond the confirmed departure date.
Receiving official mail, registering a business, installing equipment, altering locks or registering the Unit as a residence requires prior written approval and compliance with local law. Where registration is lawfully permitted, the Guest must complete any required deregistration promptly at departure.
For longer stays we may require periodic cleaning, inspection, updated identity information, interim payment or a refreshed deposit. Any such condition will be disclosed in the booking terms.
Back to contents ↑24
Refusal, suspension, removal and future booking bans
We may refuse check-in, suspend services, deactivate credentials, require visitors to leave or terminate the Accommodation Contract immediately for a Serious Breach or where continued occupation creates a material legal, safety, security or property risk.
Grounds may include false identity or payment information, unlawful purpose, prohibited resale, unauthorised occupancy, alcohol or drugs, violence or threats, deliberate damage, tampering with safety systems, repeated disturbance, refusal of essential lawful access, non-payment or a material breach not remedied after reasonable notice.
Where proportionate and lawful, the responsible person and associated fraudulent accounts may be refused future bookings. A ban will be based on documented conduct and may be reviewed on request. The refund position following termination depends on responsibility for the breach, mitigation and mandatory law.
Back to contents ↑25
Serious-breach charge and recovery of losses
The Guest or other responsible person must pay reasonable, documented loss caused by their breach. Recoverable heads may include repair, replacement, specialist cleaning, emergency attendance, security, relocation of affected Guests, chargeback costs, regulatory costs directly caused by the breach, lost revenue during a reasonable period of unavailability and reasonable legal or investigation costs where a court, contract or applicable law permits them.
Proposed EUR 10,000 clause — counsel approval required. If expressly repeated in the booking confirmation and enforceable under the law governing that stay, a grave breach involving unlawful activity, prohibited substances, deliberate concealment, violence, serious exploitation or a material safety threat may trigger a contractual claim up to the local-currency equivalent of EUR 10,000.
This is not an automatic fine or punishment. The amount must be a reasonable estimate of recoverable loss, must be reduced if the responsible person proves a materially lower loss, cannot duplicate another recovery and does not prevent recovery of a higher proven loss where the law allows.
A person who breaks the law bears their own defence expenses, fines, penalties, damages and lawful costs imposed on or recoverable from them. One Guest is not made liable for another person’s offence merely by association; responsibility must have a lawful contractual, causative or fault-based basis.
Back to contents ↑26
Incidents, investigations and public authorities
Guests must report emergencies, suspected crime, serious injury, fire, major damage and lost access credentials promptly. They must preserve relevant evidence and cooperate reasonably with a lawful safety or incident investigation.
We may preserve and disclose relevant booking, identity, access, payment, communication, damage and incident records to police, courts, tourism, immigration, tax or other competent authorities when legally required or lawfully necessary to protect people, rights and property.
We do not promise confidentiality against a binding legal request and do not obstruct lawful investigations. Disclosure will be limited to what is reasonably necessary and handled under the Privacy Policy. Reporting or investigation does not by itself prove wrongdoing.
Back to contents ↑27
Personal belongings, lost property, safes and parking
Guests remain responsible for passports, money, jewellery, electronics, vehicles and other belongings. Doors and windows should be secured and any provided safe used according to its instructions. Statutory hotelkeeper liability, where applicable, is not excluded.
Items found after departure may be stored for a reasonable period, then transferred, donated, recycled or disposed of as law permits. Return is arranged at the Guest’s risk and expense and may carry a reasonable handling cost disclosed in advance. Perishable, unsafe or unlawful items may be disposed of immediately.
Any parking, bicycle storage or luggage area is provided subject to its stated rules and does not create a custody agreement unless expressly confirmed. Damage or theft must be reported promptly to both us and the relevant authority or insurer.
Back to contents ↑28
Service issues, complaints and duty to mitigate
A defect or service issue should be reported as soon as reasonably possible through the contact stated in the confirmation so we can investigate and attempt a remedy. The Guest should provide the booking reference, a clear description and proportionate supporting evidence.
The Guest must take reasonable steps to prevent avoidable loss, must not arrange disproportionate repairs without authorisation except in a genuine emergency, and should allow a reasonable opportunity to inspect or correct the problem.
Send unresolved complaints to hello@asfourstays.com. We will acknowledge and investigate under the complaints process applicable to the Accommodation Provider. This clause does not shorten a mandatory consumer deadline.
Back to contents ↑29
Liability, exclusions and indemnity
We are responsible for providing the confirmed accommodation with reasonable care and skill. Nothing excludes or limits liability for fraud, wilful misconduct, death or personal injury caused by negligence where exclusion is prohibited, breach of a mandatory consumer guarantee, or any other liability that cannot lawfully be limited.
Subject to those protections, we are not responsible for loss caused by the Guest, an unrelated third party or an event outside reasonable control; for an unavailable third-party service we do not control; or for indirect, unforeseeable or business loss arising from a consumer stay. Any permitted monetary limit must be stated in the property schedule and reviewed under the governing law before use.
The Guest must compensate the Accommodation Provider for a third-party claim caused by that Guest’s unlawful or culpable conduct, but only to the extent of responsibility established under applicable law. This indemnity does not cover loss caused by our own negligence or breach and does not displace mandatory consumer allocation of risk.
Back to contents ↑30
Events beyond reasonable control
Neither party is liable for delay or failure caused by an event beyond reasonable control, such as natural disaster, epidemic restrictions, war, terrorism, civil disorder, widespread utility or network failure, government order, transport shutdown or serious building emergency, to the extent performance is actually prevented.
The affected party must notify the other where practicable and take reasonable steps to reduce disruption. Payment obligations already due are not automatically excused. If the stay cannot lawfully or safely be provided, relocation, cancellation and refund consequences will follow mandatory law and the applicable rate conditions.
Back to contents ↑31
Privacy and communications
Personal data is handled as described in the Privacy Policy and any property-specific notice. Booking, check-in and safety records may be required for contract performance, legal registration, fraud prevention and protection of people and property.
Operational messages may be sent by email, telephone, SMS, WhatsApp or another channel the Guest uses or accepts. Marketing is separate and will be sent only where a lawful basis exists, with a working opt-out.
The Guest must provide reliable contact details and monitor them during the stay. A notice sent to the latest supplied email or phone number is treated as received according to applicable law, not merely because it was dispatched.
Back to contents ↑32
Governing law, jurisdiction and dispute resolution
Unless mandatory law requires otherwise, Qatar law governs use of the central website and services supplied directly by Asfour Hospitality & Technology W.L.L., Level 22, Tornado Tower, West Bay, Doha, State of Qatar, CR No. 208741 (“Asfour”, “we”, “us” or “our”). The Accommodation Contract may instead be governed by the law identified in its confirmation and by mandatory law of the country where the property is located.
Nothing deprives a consumer of non-waivable protection or access to a court available under applicable consumer or private-international-law rules. An exclusive business-to-business jurisdiction may be agreed in the confirmation where lawful.
The Guest and Accommodation Provider should first attempt good-faith resolution through the complaints channel. Any consumer mediation or tourism complaint body that must legally be offered will be identified for the relevant property before public launch.
Back to contents ↑33
General provisions, changes and language
We may update these Terms prospectively for legal, operational or security reasons. The version accepted when a booking is made normally governs that booking unless a change is required by law or expressly agreed. The current version and update date will remain available online.
If one provision is invalid or unenforceable, it will be limited to the minimum extent necessary and the remaining provisions continue. Delay in enforcing a right is not a waiver. Rights and obligations may be assigned as part of a genuine transfer of the accommodation business, subject to law and notice where required.
English and Arabic versions are provided for accessibility. Before launch, local counsel must specify which version prevails for each contracting entity and ensure the Arabic legal translation is certified where required. No informal translation overrides mandatory law.
